The Emergency Economic Stabilization Act of 2008 (EESA) states, in summary of pages 71 through 75, states that if a vehicle "draws propulsion using traction battery with at least 4 KW hours of capacity", "uses an offboard source of energy to recharge such battery", is a passenger vehicle with a "gross vehicle weight rating of not more than 8500 pounds", has a "certificate of conformity under the Clean Air Act and meets or exceeds the equivalent qualifying California low emissions vehicle standard" qualifies for a tax credit based on KW hours of performance.
Ruff and Tuff Electric Vehicles come with an LSV (Low Speed Vehicle) package standard. This package includes headlights, tail lights, blinkers, DOT certified seatbelts, rear view mirror, solid windshield and wiper and NTHSA 17-digit vehicle identification. This ensures that the vehicle is, under federal law, legal to drive on roads with speed limits under 35 mph as a vehicle.
The CEV and NEV models are rated at 8.1 kilowatt hours and the CLX and 4x4 models are rated at 11.04 kilowatt hours. Therefore, the CEV and NEV models are eligible for a total credit of $4209.70. The CLX and 4x4 models are eligible for a total credit of $5435.68 calculated as follows: $2500.00 PLUS $417.00 for every kilowatt hour in excess of 4. This is a dollar for dollar tax credit. As long as you pay in at least the amount of the tax credit, you are eligible to receive the credit.
